Welcome to AIStaging. These Terms of Service ("Terms") govern your use of our AI virtual staging service available at aistaging.app (the "Service") operated by AIStaging ("we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

AIStaging provides an AI-powered virtual staging service that transforms empty rooms into furnished spaces using artificial intelligence technology. Our Service allows users to:

  • Upload photos of empty or furnished rooms
  • Apply various design styles and furniture arrangements
  • Generate weather transformations for outdoor photos
  • Remove existing furniture from photos
  • Download processed images for real estate marketing

3. AI Technology Disclaimer and Limitations

IMPORTANT: Please read this section carefully as it contains critical information about the limitations of our AI technology.

3.1 AI Imperfections and Limitations

Our AI software is not perfect and can make mistakes. The artificial intelligence technology we use may:

  • Add furniture, fixtures, or decorative elements that are not realistic or appropriate
  • Remove or alter existing architectural features, windows, doors, or structural elements
  • Change room proportions, lighting, or perspective in unnatural ways
  • Create inconsistent shadows, reflections, or lighting effects
  • Generate furniture or objects that defy physics or realistic placement
  • Alter colors, textures, or materials in unexpected ways
  • Produce results that do not accurately represent the original space

3.2 User Responsibility

By using this Service, you acknowledge and agree that:

  • It is your sole responsibility to review and verify the accuracy of all AI-generated images
  • You must ensure that any AI-generated images you use are appropriate and accurate for your intended purpose
  • You are responsible for any consequences arising from the use of AI-generated images
  • You should not rely solely on AI-generated images without proper review and verification

3.3 No Liability for AI Results

AIStaging takes no responsibility for the results of our AI-generated images. We specifically disclaim any liability for:

  • Inaccurate or unrealistic staging results
  • Misrepresentation of property features or characteristics
  • Any personal or business losses or damages resulting from the use of AI-generated images
  • Client dissatisfaction or legal issues arising from AI-generated content
  • Any errors, omissions, or inaccuracies in the AI-generated images

4. Eligibility and Age Requirements

You must be at least 18 years of age to use this Service. By using our Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18 years of age, you are prohibited from using or accessing the Service.

If we learn that we have collected personal information from someone under 18 years of age, we will delete that information as quickly as possible. If you believe that we might have information from or about someone under 18, please contact us immediately.

5. User Accounts and Registration

To use certain features of our Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

6. Subscription Plans and Billing

6.1 Service Plans

We offer various subscription plans:

  • Free Plan: 2 photos per month with watermarked images
  • Standard Plan: $29/month for 50 photos with unlimited regenerations
  • Professional Plan: $69/month for 150 photos with advanced features
  • Agency Plan: $149/month for 400 photos for growing agencies
  • Enterprise Plan: Custom pricing for high-volume needs

6.2 Billing and Payment

  • Subscription fees are billed monthly in advance
  • All payments are processed securely through Stripe
  • Unused photo credits may roll over to the next month (paid plans only)
  • You may cancel your subscription at any time
  • Refunds are not provided for partial months of service

7. Acceptable Use Policy and Content Restrictions

7.1 Prohibited Content

We strictly prohibit the upload of inappropriate images. You are expressly prohibited from uploading, transmitting, or otherwise making available through the Service any content that:

  • Contains nudity, sexually explicit material, or pornographic content
  • Depicts violence, graphic content, or disturbing imagery
  • Contains illegal substances, weapons, or criminal activity
  • Includes hate speech, discriminatory content, or harassment
  • Violates privacy rights or contains unauthorized personal information
  • Infringes on intellectual property rights or copyrights
  • Is defamatory, libelous, or intentionally misleading
  • Contains malicious code, viruses, or harmful software

7.2 General Prohibited Uses

You agree not to use the Service to:

  • Upload illegal, harmful, or inappropriate content as defined above
  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Upload content containing personal information of third parties without consent
  • Attempt to reverse engineer or replicate our AI technology
  • Use the Service for any fraudulent or deceptive purposes
  • Overload or interfere with our systems
  • Circumvent any security measures or access controls

7.3 Content Monitoring and Enforcement

We reserve the right, but are not obligated, to monitor, review, and remove any content that violates these Terms. We may suspend or terminate accounts that repeatedly violate our content policies. Violation of these content restrictions may result in immediate account termination without refund.

8. Content and Intellectual Property

8.1 Your Content

You retain ownership of the original photos you upload. By uploading content, you grant us a license to process, store, and generate staging results for your use.

8.2 Generated Content

AI-generated images are provided for your use, but we make no claims regarding intellectual property rights in AI-generated content. You are responsible for ensuring appropriate use of generated images.

8.3 Our Intellectual Property

The Service, including our software, algorithms, and branding, is protected by intellectual property laws and remains our exclusive property.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Data Loss Disclaimer

IMPORTANT: Please read this section carefully regarding data storage and potential data loss.

We are not responsible for any data loss. While we implement reasonable security measures and backup procedures, you acknowledge and agree that:

  • We cannot guarantee the permanent availability or security of your uploaded content
  • Technical failures, system outages, or other unforeseen circumstances may result in data loss
  • We are not liable for any loss, corruption, or deletion of your photos, projects, or account data
  • You are solely responsible for maintaining backup copies of your important content
  • We strongly recommend keeping local copies of all original photos and important generated content
  • Account termination, whether voluntary or involuntary, may result in permanent data deletion

Your Responsibility: It is your responsibility to regularly backup and save any content that is important to you. We recommend downloading and storing copies of your generated images and maintaining backups of your original photos outside of our Service.

No Recovery Guarantee: In the event of data loss, we cannot guarantee the ability to recover or restore your content, regardless of the cause of the loss.

11. Disclaimers and Limitation of Liability

11.1 Service Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AISTAGING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.

11.3 Maximum Liability

Our total liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless AIStaging and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorney fees) arising out of or relating to your use of the Service, your content, or your violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will cease immediately.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where AIStaging is incorporated, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
